Kraft Foods spin-off Mondelez accuses Kellogg of using its patented “Snack ‘n Seal” technology on Kellogg’s Keebler Sandies cookie brand.
Mondelez started legal proceedings against Kellogg in a US district court in Illinois yesterday.
Snack n’ Seal was created by Mondelez to help reseal snacks such as cookies that feature containers inside the outer packaging material to hold the product and prevent breakage.
A patent for the technology was granted in 2005 and is available HERE.
Mondelez accuses Kellogg of infringing its patent by packaging ranges of Sandies cookies using the sealing technology.
It claims that Kellogg re-closing method is too similar to its patented invention and is calling for damages and a court order for Kellogg to destroy all products using the sealing method.
