Louann Clem, the plaintiff, claimed her husband suffered from “extreme gas and uncomfortable diarrhoea” due to gastric bypass surgery he underwent in 2010 to correct his obesity, according to a court transcript from the US District Court of New Jersey.
The plaintiff alleged her 420-pound husband Richard Clem had been unfairly treated by his employer, Case Pork Roll Company, who dismissed him in 2015 after growing fed up with his continual farting.
'Pain and suffering'
According to multiple US reports, Louann Clem reportedly quit the company on the day her husband was fired. She duly filed a discrimination lawsuit under the Americans with Disabilities Act, against company president Thomas Dolan and owner Thomas Grieb.
Clem was seeking compensatory damages, punitive damages and liquidated damages for the “emotional pain and suffering” allegedly caused by the defendant, Case Pork Roll Company.
The defamation claim was dismissed by US district court judge Fred Wolfson in July 2015, and a revised version of the lawsuit has performed no better.
